The Ultimate Broadway x Pickleball Giveaway

Eligibility: The Giveaway is open to anyone who: (i) is at least eighteen (18) years of age; (ii) is a legal resident of the United States; and (iii) has an active Instagram account at the time of entry. Employees, independent contractors, interns, officers, directors, and agents of Nettie Pickleball Co., Hamilton Uptown LLC, Civilian Hotel and CityPickle are not eligible to enter the Giveaway. By participating, each entrant agrees to be bound by the terms and conditions of the Giveaway, as set forth herein, and the decisions of Nettie Pickleball Co., which shall be final and binding. All applicable federal, state, and local laws and regulations apply to the Giveaway and are incorporated herein by reference.

Entry Period: The Giveaway entry period will begin at 12:00 am (PDT) on October 2nd, 2023 and end at 11:59 pm (PDT) on October 9, 2023 (the “Entry Period”).

How to Enter: During the Entry Period, eligible entrants, as more particularly described above, must: (i) Follow Nettie (@playnettie) Hamilton (@hamiltonmusical) Civilian (@civilianhotel) CityPickle (@CityPickle)on Instagram; and (ii) subscribe to emails from Nettie Pickleball Co., Hamilton Uptown LLC, Civilian Hotel and CityPickle by visiting LINK and completing the email capture form.

Prize: The Giveaway winner will be the recipient of:

• 2 tickets to the hit Broadway Musical, Hamilton in NYC
• 2 Limited edition, collector Hamilton x Nettie Pickleball Paddles
• 1-night stay at Civilian Hotel
• $200 Visa Gift Card for travel credit
• 1 hour of court time at NYC’s CityPickle

Winner Selection: All entries will be entered into a random generator of Nettie’s choosing and one (1) winner will be selected on or around October 11th, 2023. Nettie will reach out to the winner via email to notify them on or around October 11, 2023. At Nettie’s sole and unilateral discretion, an alternate winner will be selected if the originally selected winner does not respond in a reasonable amount of time. The odds of winning the Giveaway depend on the number of eligible entries received for the applicable drawing.

Exclusions and Limitations:
Notwithstanding the Eligibility section, as set forth above, to redeem the Nettie 1-night stay, winners must be at least eighteen (18) years of age. This is valid toward one (1) booking only and cannot be redeemed for cash value. Any portion of the total travel credit that goes unused during that single booking will be forfeited and will not roll over to another booking. The use of these travel credits is subject to Civilian Hotel & Hamilton Uptown LLC’s availability and blackout dates, as applicable. The 1-night stay must be completed between the dates of January 3rd, through March 1st, 2024

Transportation costs incurred in association with any portion of the Prize or the redemption thereof are not included. Any difference between the approximate retail value and the actual value of the Prize, if any, will not be awarded. No part of the Prize is transferable. Nettie will not be responsible for replacing any lost or stolen Prize or component thereof. The winner may not transfer, assign, or substitute the Prize. The Prize is awarded "as is", without any warranty or guarantee, either express or implied by Nettie.

General Conditions: By entering the Giveaway, you are acknowledging and agreeing to these Giveaway terms and conditions, together with Nettie’s terms and conditions, which apply to all site users and guest reservations. Nettie retains and reserves the right to investigate participation in the Giveaway for any fraudulent or illegal activities and take any measures to end them. Nettie reserves the right to modify, suspend, or terminate the Giveaway or these Giveaway terms and conditions at any time and for any reason. Any changes to these terms and conditions made will be effective immediately, on notice, which Nettie may publish via an Instagram post. Entrants, by participating, agree that Nettie Pickleball Co., Hamilton Uptown LLC, Civilian Hotel and CityPickle, affiliates, subsidiaries, and advertising and promotional agencies and all of their respective officers, directors, employees, representatives, and agents (collectively, the “Released Parties”) shall have no liability whatsoever for, and shall be held harmless by entrants from and against, any liability for any injuries, losses, claims, or damages of any kind whatsoever, including death, to persons or property, resulting in whole or in part, directly or indirectly, from: (i) acceptance, possession, misuse, or use of a Prize; (ii) participation in the Giveaway; and/or (iii) use of Nettie’s website or social media platforms. The winner, by acceptance of the Prize, except where legally prohibited, grants permission for Nettie and its designees (including, but not limited to, the Released Parties) to use their name, Instagram username/handle, photograph (including profile photo), voice, and/or other likeness and Prize information for advertising, trade, and promotional purposes, without further compensation, in all media now known or hereafter discovered, worldwide, and in perpetuity, without notice, review, or approval beyond that which is contained herein. This Giveaway is subject to all federal, state, local, municipal, provincial, and local laws, and shall be void wherever prohibited or restricted by national, state, municipal, provincial, or any other government laws. To the extent permitted by law, these Giveaway terms and conditions shall be exclusively governed by, enforced, and construed in accordance with the laws of the State of Ohio. The jurisdiction and venue for any dispute shall be exclusively in a competent court within Hamilton County, Ohio.
